DMCA Policy
Zero Waste Ginger Syrup is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and expect our users to do the same. This policy outlines the procedures for copyright owners to notify us of alleged copyright infringement and for users to file counter-notifications if they believe their content was removed in error.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on or associated with Zero Waste Ginger Syrup infringes upon your copyrights, you may submit a written DMCA Notice of Infringement to our Designated Copyright Agent. Your notice must include substantially the following information:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: A description of the material that you claim is infringing and where it is located on our platform (e.g., URL or specific product/content name). Please provide sufficient detail to allow us to locate the material.
- Your Contact Information: Your name, address, telephone number, and email address.
- Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receipt of a valid DMCA notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material. We may also notify the user who posted the material about your complaint.
Filing a DMCA Counter-Notification
If you believe that material you posted was removed or access to it was disabled as a result of mistake or misidentification, you have the right to file a DMCA Counter-Notification. Your counter-notification must include substantially the following information:
- Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled, and the location (e.g., URL) at which the material appeared before it was removed or disabled.
- Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your Contact Information: Your name, address, telephone number, and email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Zero Waste Ginger Syrup may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Physical or Electronic Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will promptly provide the original complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days unless we receive notice from them that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity.
